General conditions of use
1 - Definitions
1.1 “Home Select” refers to the mobile application and the website published by our company, specialized in premium real estate research.
1.2 “User” refers to any natural person using the Home Select application.
1.3 “Services” refers to the services offered by Home Select, in particular the search for quality apartments.
1.4 “Real Estate Partner” refers to real estate agents in collaboration with Home Select.
2 - Purpose
The purpose of these General Conditions is to define the conditions of use of the Services offered by Home Select.
3 - Register on Home Select
3.1 The User must register on Home Select to access the Services. To register, the User must be at least eighteen (18) years old and be legally capable of contracting.
3.2 The User guarantees that he is acting on his own behalf and not on behalf of a legal person or for professional purposes.
3.3 When registering, the User must provide complete and accurate information. A confirmation link will be sent by email to finalize the registration.
3.4 The User is responsible for the confidentiality of his identifiers (username and password). In case of disclosure of his identifiers, the User must contact Home Select to deactivate them.
4 - Services offered by Home Select
4.1 Home Select offers the User the possibility to search for quality apartments through its application.
4.2 To perform a search, the User must enter criteria such as location, maximum rent, minimum surface area, etc.
4.3 Home Select then presents the search results to the User, bringing together the corresponding ads.
4.4 The User can access real estate ads via direct links to the sites of real estate partners.
5 - Availability of Home Select
5.1 Home Select is accessible via the mobile application and the website.
5.2 The User is responsible for the Internet connection required to use Home Select.
5.3 Home Select strives to maintain the availability of its Services 24 hours a day, 7 days a week. However, technical hazards may cause temporary interruptions.
5.4 Home Select reserves the right to temporarily suspend access for maintenance operations.
6 - Protection of personal data
6.1 Home Select processes the User's personal data in accordance with applicable legislation.
6.2 The data collected is used to allow access and use of the Services, as well as for statistical and marketing analysis purposes.
6.3 The User has rights over his personal data, in particular the right to access, modify, oppose and delete his personal data.
6.4 Home Select is committed to protecting the confidentiality of User data.
7 - Intellectual property
7.1 Home Select is the exclusive property of our company.
7.2 The User has a personal and non-exclusive right to use Home Select. No content may be downloaded, copied, modified, etc., without the consent of Home Select.
8 - User commitments
8.1 The User undertakes to have an Internet connection and to maintain the confidentiality of his identifiers.
8.2 The User must not use Home Select in such a way as to interfere with its operation or to break the law.
9 - Responsibility
9.1 Home Select does not guarantee the absence of bugs and cannot be held responsible for interruptions due to external factors.
9.2 Home Select is not responsible for damage caused by third parties or external causes.
10 - Duration
These General Terms and Conditions are concluded for an indefinite period from the activation of the User's account.
11 - Various stipulations
11.1 Force Majeure: The Parties are released from their obligations in the event of Force Majeure.
11.2 Modification of the General Conditions: Home Select reserves the right to change the General Conditions.
11.3 Notification of illegal content: The User may report any illegal content on Home Select.
11.4 Proof agreement: Computerized records are considered as evidence of the User's actions.
11.5 Waiver: No waiver of the exercise of rights is implied.
11.6 Partial invalidity: If one clause is invalid, the others remain in force.
11.7 Opposition to telephone canvassing: The User may oppose telephone canvassing in accordance with the law.
12 - Applicable law and disputes
12.1 Applicable law: The Contract is governed by French law.
12.2 Disputes: Any dispute relating to these General Terms and Conditions falls under the jurisdiction of the French courts.
