An Exclusive Research Mandate

It is not a restriction of freedom but on the contrary a great asset to allow us to find. For us, this exclusivity is a guarantee of the seriousness, motivation and validity of your approach.

This is the guarantee of our objectivity towards you because since we will find your property and are the only ones authorized to do so, we will therefore never put the least pressure on you to influence you to acquire a property if you are not completely convinced and satisfied with it.

Faced with agencies, if you are not an exclusive client, we cannot have the same weight or the same arguments to offer collaboration and allow you to benefit from a great opportunity.

This trust requires us to prioritize this research over our other portfolio research.

A real estate hunter is only paid when the authentic act is signed, so it is possible that he searched for nothing, without any commission. Since you are signing an exclusive mandate, we specify that “the Principal is prohibited, throughout the duration of the Research Mandate and that of its renewal, from conducting its research by itself or via another intermediary and from negotiating with any seller presented or not by the Agent”.
This rule should not discourage you, as we agree to visit properties that you present to us ourselves. You therefore maintain real freedom in research and you can intervene on it at your level. In addition, in order to increase efficiency, we always ask the client to send us the most complete list possible of the properties already visited or identified.

2. Our remuneration is always clear to you.

We are committed to working transparently with our customers. Thus, we provide all the information relating to our remuneration as part of an exclusive research mandate. This compensation is specified including VAT (all charges included) and is based on the actual net seller purchase price, if you buy one of the goods we have offered you. If necessary, we can also choose another method of remuneration by mutual agreement. Payment will be made on the day the authentic instrument is signed.
If you buy a property that we have offered to you within 12 months after the expiry of the mandate, the fees provided for in the contract are still applicable.

What is a research mandate?

As explained in the introduction, the search mandate is a contract signed between the real estate hunter and his acquiring client. The first is called a mandatary while the second — a natural or legal person — is called a mandatary.
There are three types of research mandates. First of all, there is the one called a “simple search warrant.” It allows the buyer to involve more than one apartment hunter, but also to carry out his own research himself or herself. Then there is the semi-exclusive search mandate. This allows the customer to do their own research, but requires them to use only one hunter. Finally, the exclusive mandate gives full responsibility for the research to the expert.

What is the difference between a search mandate and a sales mandate?

A search warrant, which might more appropriately be called a “purchase warrant,” is given to a real estate hunter or apartment hunter. Their objective is to search for and find real estate that matches your specific search criteria. Hence the term “real estate search mandate”. On the other hand, a sales mandate, or “sales mandate,” is given to a real estate professional, such as a real estate agent, whose objective is to sell your property. Real estate hunters, who specialize in the acquisition of property, mainly sign search mandates. On the other hand, real estate agents, who specialize in the sale of real estate, mainly sign sales mandates. It should be noted, however, that agents and hunters are allowed to sign both types of contracts.

Research mandate: what elements should be included?

Not only is it mandatory to sign a search warrant when using a real estate hunter, but several elements must also be included in the search warrant, whether simple, semi-exclusive or exclusive.
Among these elements, we find in particular all the information concerning both parties (principal and mandatary). Civility, addresses, full names and others must therefore be indicated. The description of the property also appears in the list of information contained in a search warrant. The duration of the contract, the conditions of renunciation, those related to its renewal or even the fees of the real estate hunter must also be specified.
Finally, both parties must sign and date the search warrant and keep at least one copy each.
Attention, certain articles of law must also appear in their entirety on a search warrant: L. 121-23, L. 121-24, L. 121-25 and L. 121-26. Finally, it is necessary to specify what type of mandate this is.
