A note for international buyers

The French buying process differs markedly from the UK, the US and elsewhere. In France, a purchase offer (offre d'achat) becomes a legally binding commitment the moment the seller accepts it. There is no "subject to survey" clause and no easy withdrawal. We strongly recommend engaging a property hunter familiar with the local process.

What is a purchase offer?

A purchase offer (offre d'achat) is a written document in which a prospective buyer sets out an intention to acquire a property at a stated price. It is the first formal step in the process, before the preliminary contract (compromis de vente) is signed.

Important: a purchase offer legally binds the buyer once the seller accepts it on the proposed terms. After acceptance, the buyer cannot withdraw, save where a condition precedent (such as mortgage approval) is not satisfied.

What it must contain

Your offer must include the following:

  • Full identity of the purchaser (name, address, date and place of birth)
  • Precise description of the property (address, surface area, floor, lot number)
  • Proposed price, in figures and in words
  • Validity period of the offer (typically five to ten days)
  • Conditions precedent (mortgage approval, sale of an existing property, etc.)
  • Intended method of financing
  • Date and signature of the purchaser
