Why does a property finder in France ask for my identity document?
Because the law requires it. Real estate professionals are subject to anti-money laundering obligations (Article L.561-2 of the French Monetary and Financial Code) and must verify their client's identity before entering into a relationship, that is, when the mandate is signed. At Home Select, it is the same step for every client, done once.
Do I have to provide bank statements to prove the source of funds?
As a rule, no. Home Select asks how the purchase is financed, not what is in your accounts. When proof is needed, a letter from your bank, a loan offer or approval, or the deed the funds come from is usually enough, and you may redact anything unrelated to the purchase.
What happens if I refuse to provide these documents?
The law then prohibits the professional from continuing the relationship (Article L.561-8 of the French Monetary and Financial Code), whatever the file. Home Select's mandate provides for it: its performance is suspended, then it ends if nothing is regularised. Any compliant real estate professional in France will ask you for the same information.
Is the seller checked too?
Yes. As soon as their identity is known, Home Select verifies it and makes sure they do not appear on the French Treasury's national asset freeze register. It also protects the buyer: a sale with a seller whose assets are frozen cannot be completed.
How long are my documents kept, and who can see them?
Five years after the end of the relationship, a period required by Article L.561-12 of the French Monetary and Financial Code. They are stored on servers located in the European Union and are accessible only to authorised Home Select staff. They are disclosed only to the competent authorities, in the cases provided for by law.
I live abroad: how does the check work without meeting in person?
The law then requires an additional check, for example a copy of your identity document certified by an independent professional, or confirmation of your identity by your bank or by the notary. Your property finder will tell you what suits your situation.
What is a politically exposed person, and why this question?
A person who holds, or has held within the last twelve months, a prominent political, judicial or administrative function, in France or abroad, as well as their family members and close associates. The law requires professionals to ask every client: answering yes does not prevent you from buying, it calls for additional checks.
Does this check slow down my search?
No. It is done when the mandate is signed, together with everything else, and it gets your file ready for the offer stage. Done early, it avoids discovering a missing document just when the seller is choosing between several buyers.
